[ASEMWATER Academic and Development Committee]Charter of the Academic and Development Committee

 

Chapter I    General Provisions
Article 1      The ASEM Water Resources Research and Development Center (hereinafter referred to as ASEMWATER) is an international, multilateralprofessional and non-profit organization for scientific and technological cooperation. It is jointly founded by government agencies, universities, research institutions and other stakeholders in the field of water resources from the Asia-Europe Meeting (ASEM) members. The Academic and Development Committee (hereinafter referred to as the Committee) is established in response to the development needs of ASEMWATER.
 
Article 2       The top decision-making body of ASEMWATER is the Council (to be established). The Committee and the Secretariat are established under the guidance of the Council. The Secretariat is the permanent executive body of ASEMWATER. The Committee provides advice and recommendations for ASEMWATER.
 
Article 3       This charter is formulated to clarify the functions of the Committee.
 
Chapter II   Purposes and Responsibilities
Article 4       The purpose of the Committee is to bring together the experts and scholars in the field of water resources from ASEM members to improve the scientific decision-making level of ASEMWATER and actively promote S&T cooperation in water resources among the members.
 
Article 5      The Committee provides consulting and recommendations for ASEMWATER to develop its strategies and medium and long-term development plan and organizing workshops.  Chairperson and/or Vice chairpersons of ASEMWATER, ASEM members and the Secretariat should coordinate with one another to implement and evaluate related work and activities, including the five year, annual, and specialized cooperation plans of the ASEM and report to the Council.
 
Article 6      The Committee advises ASEMWATER on the priority areas of cooperation, cooperation policies, the annual work plan and the annual work report. to provide  water resources-related policy and governance suggestions to the ASEM members.
 
Article 7       The Committee advises ASEMWATER on the selection, and evaluation of cooperation projects.The Committee should promote ASEM Network for Science, Technology and Innovation Cooperation in Water Resources.
 
Article 8       The Committee advises, upon request, the ASEM members on the development strategy, and regulations regarding water resources.
 
Article 9       The Committee undertakes other work (Asia-Europe Water Resources Science and Technology Report) commissioned by the Council.
 
Chapter III Organization
Article 10     The Committee is composed of experts and scholars in the field of water resources from ASEM members. The Committee elects a chair and a number of vice chairs. The chair oversees the overall work of the Committee. The working mechanism, mandate and annual work plan of the Committee are determined at Committee Meetings.
 
Article 11     An expert pool is established under the Committee and task groups are formed by experts selected from the pool in accordance with the requirement. The members of the expert pool are recommended by relevant agencies of ASEM members in the field of water resources.
 
Article 12     The Secretariat of ASEMWATER supports the routine work of the Committee, including the convening of the Committee Meeting.
 
Chapter IV Membership and Tenure
Article 13    The Committee members are recommended by the Secretariat in conjunction with relevant agencies of the ASEM members in consideration of the fundamental work and future planning of ASEMWATER; the membership shall reflect both regional and disciplinary representativeness. The chair and vice chairs of the Committee are elected at the general meeting.
 
Article 14     Members shall meet the following conditions:
(A) contribution to ASEMWATER development;
(B) academic achievement, industrial influence, and good ethics;
(C) a wealth of theoretical knowledge and practical experience and strong organizing and coordinating capacity;
(D) other conditions stipulated by the Committee.
(E)A member should belong to a relevant Government/non-Government organization. If a member retires from or leaves the nominating organization, his/her could nominate his/her successor to becomes the member, but the member should report to the Secretariat 3 months before his/her leave
 
Article 15    The member serves four-year tenure and can be re-elected. During the tenure, if the member is unable to participate in ASEMWATER's activities, the tenure can be terminated; the member shall promptly notify the Secretariat of his/her change of work.
 
Article 16     In accordance with the development needs of ASEMWATER, the Committee can expand the membership accordingly.
 
Chapter V   Rights and Obligations
Article 17     Members shall enjoy the following rights:
(A) to participate in the activities held by ASEMWATER and have access to information and material provided by the Committee;
(B) to have access to the files, information, data, and background material related to the consulting task and participate in relevant academic conferences;
(C) to fully express their personal opinions and/or reserve their judgment during the decision-making and consultation process;
(D) to be independently engaged in the consulting project;
(E) to express views and make recommendations to the Committee.
 
Article 18     Members shall undertake the following obligations:
(A) to comply with activity country’s relevant laws, regulations and the Committee Charter;
(B) to participate actively in the activities held by the Committee;
(C) to provide relevant scientific and technical information to the Committee, and present recommendations about the research, development, promotion and application of advanced technologies; and upon request, provide the ASEM members with development strategies, policies, and laws and regulations regarding water resources.
(D) to conscientiously undertake the consulting task, and complete it on time;
(E) to remain objective and fair in the consultation;
(F) to keep the issues and information related to the consultation confidential and never make any disclosure without the consent of the Committee.
 
Article 19    No member shall engage in commercial activities on behalf of ASEMWATER or the Committee without the consent of the Committee.
 
Chapter VI  Working Mechanism
Article 20     The Committee meeting is held on an annual basis. Upon the request of a majority of the members or of the Secretariat, an ad hoc meeting can be convened in addition to the regular annual meeting. Members, who cannot be on-site, can participate via telephone conference or video conference.
 
Article 21    Members may at any time make recommendations to the Committee through the Secretariat. At the members' request, the recommendation can be deliberated at and adopted by the Committee Meeting on site or via telephone, e-mail and other forms. The Secretariat is responsible for collecting recommendations submitted by the members and submitting them to the Committee for deliberation or to other members.
 
Article 22     The working language of the Committee is English.
 
Article 23     The decision of the Committee is made by the principle of consensus, and written into meeting minutes.
 
Article 24     Members may at any time make recommendations to the Secretariat, which shall respond within the appropriate time frame.
 
Chapter VII Miscellaneous Provisions
Article 25     The Charter comes into effect upon deliberation and approval at the 1st Meeting of the Committee.
 
Article 26     The Charter can be amended upon consultation with and approval by the Committee.
 
Article 27     The Committee is responsible for the interpretation of the Charter. Outstanding issues shall be decided by the Committee Meeting.
